Terms of Use

These Terms of Use govern the use of the PodCubo platform ("Platform", "Service"), operated by BitCubo LTDA ("BitCubo", "we"), CNPJ 31.314.893/0001-73.

By creating an account or using the Platform, you fully agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

PodCubo is a Platform as a Service (PaaS) that offers:

  • Application hosting via containers
  • Database management (MongoDB, PostgreSQL, Redis)
  • Automated backups with S3 storage
  • Automatic SSL certificates (Let's Encrypt)
  • Global CDN and DDoS protection (Cloudflare)
  • Automatic and custom domains
  • Deploy via GitHub, Docker image, or static file upload
  • Intelligent error diagnostics via AI (AI Insight)
  • Real-time usage metrics

2. User Account

  • You are responsible for maintaining the confidentiality of your account credentials
  • Information provided during registration must be true and up to date
  • You are responsible for all activities carried out under your account
  • Each person should have only one account. Duplicate accounts may be terminated
  • Minors under 18 must have authorization from legal guardians

3. Plans and Payments

3.1 Plans

The Platform offers plans with different resource limits (CPU, memory, disk). Current plans and prices are available on the website pricing page.

3.2 Trial

Each stack created has a 24-hour free trial period. At the end of the trial, payment is required to continue using the Service.

3.3 Billing

  • Billing is monthly, in Brazilian Reais (BRL), via PIX
  • All stacks from a user share the same billing cycle (unified billing)
  • Prices may change with 30 days notice

3.4 Non-payment

  • Up to 7 days past due: alerts are displayed, services continue running
  • 7 to 14 days past due: all user stacks are suspended (containers stopped, data preserved)
  • After 14 days of non-payment: all stacks and data are permanently deleted

3.5 Upgrade

  • Plan upgrades are available at any time, with pro-rata billing for remaining days
  • Plan downgrades are not allowed. To reduce resources, create a new stack with the desired plan

3.6 Cancellation

  • You may cancel your account or delete stacks at any time
  • Paid stacks with more than 5 days remaining in the cycle cannot be deleted (to prevent credit loss)
  • There are no refunds for periods already paid

4. Acceptable Use

You agree NOT to use the Platform to:

  • Violate any applicable law or regulation
  • Host malware, phishing, spam, or malicious content
  • Mine cryptocurrency
  • Perform denial-of-service attacks (DDoS) against third parties
  • Store or distribute illegal content, including child abuse material
  • Infringe third-party intellectual property rights
  • Send unsolicited emails (spam) from the Platform
  • Perform abusive scraping or crawling from containers
  • Use resources in a way that harms other Platform users

We reserve the right to suspend or terminate accounts that violate these terms, without prior notice and without refund.

5. Data and Backups

  • You are solely responsible for the content of your applications and databases
  • We strongly recommend configuring automated backups for all critical databases
  • While PodCubo offers backup tools, we do not guarantee data recovery in all circumstances
  • Deleting a stack results in permanent and irreversible removal of all associated data

6. Availability

  • We strive to maintain high availability of the Service but do not guarantee uninterrupted operation
  • Scheduled maintenance will be communicated in advance when possible
  • We are not liable for unavailability caused by external factors (infrastructure providers, attacks, natural disasters)

7. Intellectual Property

  • You retain full ownership of all content, code, and applications deployed on the Platform
  • BitCubo retains ownership of the PodCubo platform, including its code, design, brand, and documentation
  • The name "PodCubo", logos, and visual identity are trademarks of BitCubo LTDA

8. Limitation of Liability

  • To the maximum extent permitted by law, BitCubo shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the Service
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not responsible for data loss resulting from user failure to configure adequate backups
  • We are not responsible for the content of applications hosted by users

9. Termination

  • You may terminate your account at any time
  • We may suspend or terminate your account for violation of these Terms
  • After termination, your data will be kept for up to 14 days (grace period) and then permanently deleted
  • Billing data will be retained for up to 5 years as required by tax law

10. Changes to Terms

  • We may update these Terms at any time
  • Material changes will be communicated via email or Platform notification with 30 days notice
  • Continued use of the Platform after changes constitutes acceptance of the new Terms
  • If you do not agree with the changes, you must close your account before the effective date

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of the district where BitCubo LTDA is registered, to the exclusion of any other.
